ARTICLE IX.  ENFORCEMENT, VIOLATION AND PENALTY  

SECTION 405.190: ENFORCEMENT, VIOLATION AND PENALTY  

A.    It shall be the duty of the Building Commissioner to enforce this Chapter and appeals from the decision of the Building Commissioner may be made to the Board of Adjustment as herein provided.  

B.    The owner or agent of a building or premises in or upon which a violation of any provision of this Chapter has been committed or shall exist; or the lessee or tenant of an entire building or entire premises in or upon which a violation has been committed or shall exist, or the agent, architect, building contractor, or any other person who knowingly commits, takes part or assists in any violation or who knowingly maintains any building or premises in or upon which such violation shall exist, shall be guilty of misdemeanor punishable by a fine of not less than ten dollars ($10.00) and not more than one hundred dollars ($100.00) for each and every day that such violation continues, but if the offense be willful on conviction thereof, the punishment shall be a fine of not less than one hundred dollars ($100.00) or more than two hundred fifty dollars ($250.00) for each and every day that such violation shall continue or by imprisonment for ten (10) days for each and every day such violation shall continue or by both such fine and imprisonment in the discretion of the court.  

C.    Civil Penalty.  Any such person, who, having been served with an order to remove any such violation, shall fail to comply with said order within ten (10) days after such service, or shall continue to violate any provisions of the regulations made under authority of this Chapter in the respect named in such order, shall also be subject to a civil penalty of two hundred fifty dollars ($250.00).  (CC 1990 §18.160)

Part of Lots 5, 6 and 7 of the Partition of the Kenneth Shotwell Estate in the Northeast 1/4 and Southeast 1/4 of Section 29, Township 45 North, Range 4 East, according to the plat accompanying the Commissioner's Report recorded in Book 22, page 618, being more particularly described as follows:  Beginning at the intersection of the North line of Clayton Road, 40 feet wide, with the West line of Clarkson Road, 60 feet wide; thence South 89 degrees 38 minutes 25 seconds West, a distance of 1,064.30 feet to a point, said point being the East line of property conveyed to the Ellisville Methodist Church by deed recorded in Book 5112, page 235; thence North 0 degrees 58 minutes 25 seconds East along the last mentioned East line, a distance of 697.15 feet to a point; thence North 51 degrees 01 minutes 36 seconds East, a distance of 784.85 feet to a point; thence South 89 degrees 25 minutes 02 seconds East, a distance of 432.24 feet to a point in the West line of Clarkson Road; thence along the said West line of Clarkson Road, South 0 degrees 34 minutes 58 seconds West, a distance of 563.77 feet and South 1 degree 28 minutes 02 seconds East, a distance of 616.07 feet to the point of beginning, according to Survey executed by Clayton Surveying and Engineering Co., executed in February, 1975.
