AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF CLARKSON VALLEY, MISSOURI, IN TITLE III: TRAFFIC CODE, CHAPTER 310: ENFORCEMENT AND OBEDIENCE TO TRAFFIC REGULATIONS, BY DELETING SECTION 310.040: USE OF COASTERS, ROLLER SKATES AND SIMILAR DEVICES RESTRICTED AND ADDING A NEW SECTION 310.040: USE OF COASTERS, ROLLERS SKATES, MOTORIZED PLAY VEHICLES, MOTORIZED SKATEBOARDS AND SIMILAR DEVICES RESTRICTED.

            BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF CLARKSON VALLEY, ST. LOUIS COUNTY, MISSOURI, AS FOLLOWS:

            SECTION 1:  The Municipal Code, City of Clarkson Valley, Missouri, is hereby amended in Title III: Traffic Code, Chapter 310: Enforcement and Obedience to Traffic Regulations by deleting Section 310.040: Use of Coasters, Roller Skates and Similar Devices Restricted and adding a new Section 310.040: Use of Coasters, Roller Skates, Motorized Play Vehicles, Motorized Skateboards and Similar Devices Restricted.

      SECTION 2:  A new Section 310.040 shall be adopted which will read as follows: 

SECTION 310.040: USE OF COASTERS, ROLLER SKATES, MOTORIZED PLAY VEHICLES, MOTORIZED SKATEBOARDS AND SIMILAR DEVICES RESTRICTED. 

A. No person upon roller skates or riding in or by means of any coaster, toy vehicle or similar device shall go upon any roadway except while crossing a street on a crosswalk and when so crossing such person shall be granted all of the rights and shall be subject to all of the duties applicable to pedestrians.  This Section shall not apply upon any street while set aside as a play street as authorized by ordinance of the City.

B. It shall be unlawful to operate a motorized play vehicle or motorized skateboard upon any street, roadway, or sidewalk within the City.

SECTION 3:  All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed and held for naught.

            SECTION 4:  Nothing in this Ordinance shall be construed to affect any suit or proceeding pending in any Court, or any right acquired or liability incurred, or any cause or causes of action acquired or existing under any act or Ordinance hereby amended.

            SECTION 5:  Except as amended herein, Title III of the Municipal Code, City of Clarkson Valley, Missouri, shall be and will remain in full force and effect.

            SECTION 6:  This Ordinance shall be in full force and effect from and after its passage and approval as provided by law.
