AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO FIRST CHURCH OF CHRIST SCIENTIST AUTHORIZING THE LOCATION AND CONSTRUCTION OF A SIGN AT 2989 CLARKSON ROAD IN THE CITY OF CLARKSON VALLEY, MISSOURI.

            WHEREAS, an application has been received from the First Church of Christ Scientist for a Special Use Permit for the location and construction of a sign at 2989 Clarkson Road in the City of Clarkson Valley, Missouri; and

            WHEREAS, the said application has been referred to the Planning and Zoning Commission which recommended the granting of said petition; and

            WHEREAS, due notice of a public hearing before the Board of Aldermen for such petition was published according to law and Ordinance; and

            WHEREAS, a public hearing was held on July 6, 2005 at which time the said application was considered; and

            WHEREAS, the location and construction of a sign under certain conditions constitutes a demonstrable need and would generally be in keeping with the standards set forth in Section 405.120 of the Clarkson Valley Land Use Ordinance;

            NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF CLARKSON VALLEY, ST. LOUIS COUNTY, MISSOURI, AS FOLLOWS:

            SECTION 1:  A Special Use Permit, subject to the conditions hereinafter specifically set forth, is hereby granted to the FIRST CHURCH OF CHRIST SCIENTIST to locate and construct a sign at 2989 Clarkson Road in Clarkson Valley, Missouri, as is provided for in Section 405.120 of the Clarkson Valley Land Use Ordinance. 

            SECTION 2:  The Special Use permit hereby issued and referred to in Section One is issued to the named permittee only and shall not be assigned nor transferred.

            SECTION 3:  The Special Use Permit hereby issued and referred to in Section One is shall be valid only under the following conditions:

1. The sign shall be located and constructed on the premises at 2989 Clarkson Road in the City of Clarkson Valley, Missouri, and shall be set back approximately nineteen (19) feet from the curb to the property line and an additional seven (7) feet to the property line as set forth in the attachment to the application marked Exhibit "A". 

2. The sign shall be a double-faced, lighted sign proclaiming church services, Sunday school and three lines for a 6" changeable text message, constructed substantially as set forth in the attachment to the applications marked Exhibit "B(3)".

3. The sign shall be no larger than 5'3" x 12' (60.25 sq. ft.) x 6" wide with aluminum skirt and aluminum post frame and shall be meticulously maintained with respect to weathering and vandalism.

4. The applicant shall notify, in writing, the City Clerk within 30 days from the passage of this Ordinance that the Special Use Permit as provided for herein is accepted, together will all conditions and that they will be observed. 

SECTION 4:  This Ordinance shall be in full force and effect from and after its passage and approval as provided by law.
