BILL NO. 0433 ORDINANCE NO. 12-xx
AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO MR. JAMES BABB TO LOCATE SOLAR ENERGY SYSTEMS AT PROPERTY KNOWN AS 2001 KEHRSDALE CT. IN THE CITY OF CLARKSON VALLEY, MISSOURI.

WHEREAS, an application has been received from JAMES BABB for a Special Use Permit for the permanent location of solar energy systems at property known as 2001 Kehrsdale Ct. in the City of Clarkson Valley, Missouri; and
WHEREAS, the said application has been referred to the Planning and Zoning Commission which recommended the granting of said petition; and
WHEREAS, due notice of a public hearing before the Board of Aldermen for such petition was published according to law and Ordinance; and
WHEREAS, a public hearing was held on February 7, 2012 at which time the said application, including any proposed amendments and/or proposed revisions to the application, was considered; and
WHEREAS, the location of permanent solar energy systems under certain conditions constitutes a demonstrable need and would generally be in keeping with the standards set forth in Section 405.120 of the Clarkson Valley Land Use Ordinance;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF CLARKSON VALLEY, ST. LOUIS COUNTY, MISSOURI, AS FOLLOWS:
SECTION 1: A Special Use Permit, subject to the conditions hereinafter specifically set forth, is hereby granted to JAMES BABB to locate a building mounted solar energy system on the roof consisting of 52 panels and a ground mounted solar energy system consisting of three arrays totaling 48 panels to be situated 96' from the west side yard at the property known as 2001 Kehrsdale Ct. in the Kehrs Mill Estates Subdivision, Plat 5, Section 1 in the City of Clarkson Valley, Missouri, as is provided for in Section 405.120 of the Clarkson Valley Land Use Ordinance.
SECTION 2: The Special Use permit hereby issued and referred to in Section One is issued to the named permittee only and shall not be assigned nor transferred.
SECTION 3: The Special Use Permit hereby issued and referred to in Section One shall be valid only under the following conditions:
1. The panels shall be installed as set forth in the attachment to the application marked Exhibit "A".
2. The panels shall be constructed substantially as set forth in the attachment to the applications marked Exhibit "B", parts 1, 2 and 3.
3. All supports and flashing shall be painted a dark gray to match roof color. All panels shall be meticulously maintained with respect to the elements, weathering and vandalism and shall be removed when system becomes non-functional or when owner ceases to use systems.
4. The applicant shall notify, in writing, the City Clerk within 30 days from the passage of this Ordinance that the Special Use Permit as provided for herein is accepted, together will all conditions and that they will be observed.
SECTION 4: This Ordinance shall be in full force and effect from and after its passage and approval as provided by law.
