The meeting was called to order at 7:30 p.m. A

Chairman,
Wendell Sittser, announced the start of the Meeting, and after leading the
Pledge of Allegiance, stated that Mayor Douglass was unable to attend this
meeting and that he would be presiding.
Alderperson Schultz made a motion to accept the Minutes. Alderperson Schiller seconded the motion. A voice vote was taken with an affirmative result and the motion was declared passed.
REMARKS, PETITIONS, COMPLAINTS
Planning
and Zoning Chairman, Frank Hodgdon referred to the letter dated October 10, 2006
to the St. Louis County Boundary Commission. He asked if the City was
requesting the annexation or if it was Ballwin that wanted the portion of
Clarkson Road? He stated that his concern for the City arose from a
monetary standpoint regarding traffic tickets issued on that stretch.

Police Report:
In Captain Schicker's absence, Lt. Lorne handed out the October Police Report.

Court
Report:
The total amount collected for traffic fines and court costs for the
month of October 2006 was $12,857.75.
Striping
on Clarkson Road:
Chairman Sittser stated that MoDOT is almost finished with the striping
on Clarkson Road.
Sound
Measurements Taken on Clarkson Road:
Chairman Sittser said that Mayor Douglass was informed that MoDOT
conducted sound measurements but the information is not available. He asked if anyone noticed a difference in sound level, to
which Alderperson Mixson said there was a substantial difference.
Alderperson Schultz agreed.
Alderpersons’ Reports:
Forest
Hills Club Estates Experiencing Infill:
Alderperson Schultz mentioned that Forest Hills Club Estates Trustees
were approached by a home owner that would like to demolish the existing slab
house and reconstruct a new home on Hillock Lane.
He said they have not seen the plans as yet, but have approved the
preliminary proposal.
Request
for Work Session: Alderperson Schiller stated that she spoke with Mayor
Douglass, requesting the Board of Aldermen hold a work session to discuss how
complaints are handled in the City. It
seems, she said, people keep getting extensions on their various complaint
charges. She has concern over
ordinances that aren't being enforced. The
allowed time of one year for any open building permit was mentioned.
City Attorney’s Report
Waterfall/Pond
and Certain Encroachments Thereof: Patrick Butler reported that Mayor Douglass, Dick Fox (the
prosecuting attorney) and he considered what to do about a certain infraction.
He said they went around-and-around, until it was decided the matter
would be referred to the municipal court.
Group
Home:
He reported the City would file a TRO against the homeowners, whom he
believes currently reside in Phoenix, Arizona.
He said that in a conference call with the attorney representing the
group of women, they would most likely file an application for a Class B Group
Home within the next week.
Sound
Wall:
He said the appeal regarding the sound wall is due December 8 and MoDOT's
response will be due in January 2007. We
would then make our reply in February. By
spring, he said, we should have an answer.

BUSINESS
Bill No. 0340 - 2003 International Building Code and 2003 International Residential Code: Chairman Sittser reminded those present that Bill No. 0340 was tabled last month in order for the Alderpersons to have time to look at the parameters. Alderperson Schiller made a motion to table Bill No. 0340 again this month and review it in the working meeting, which she is requesting. Alderperson Schultz seconded the motion. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.
NEW BUSINESS
Chairman
Sittser advised there are five new Bills the City is considering tonight that
will bring the City into conformance with state statutes.
He requested that motions be made to pass and discuss the following
Bills:
BILL
NO. 0341 - AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF CLARKSON
VALLEY, MISSOURI, IN TITLE III: TRAFFIC CODE, CHAPTER 320: SPEED REGULATIONS, BY
ADDING A NEW PARAGRAPH E TO 320.030: SPEED RESTRICTIONS.
Alderperson
Schiller made a motion to consider and pass Bill No. 0341.
Alderperson Schultz seconded the motion. Per the suggestion of City Attorney, Patrick Butler,
Alderperson Mixson made a motion to read all Bills at this evening's meeting by
short title. Alderperson Schiller
seconded the motion. A voice vote
was taken with a unanimous affirmative response.
Chairman Sittser read Bill No. 0341 the first time.
He explained that this Bill gives definition of construction zone and
work zone. City Attorney, Patrick
Butler answered the questions that were asked.

A roll call vote was taken with the following results:

DISTURBING THE PEACE, BY ADDING A NEW SUB-PARAGRAPH 3 TO PARAGRAPH B.

Bill
No. 0345 - POST: A motion was made and seconded to discuss Bill No. 0345.
Chairman Sittser read Bill No. 0345 in its entirety.
After much discussion, a motion was made by Chairman Sittser, seconded by
Alderperson Mixson, to table Bill No. 0345 until next month's working session
and meeting. A voice vote
was taken with a unanimous affirmative result and the motion was declared
passed.
Audit:
Alderperson Schiller made a motion, seconded by Alderperson Schultz to
have invoices in the amount of $84,978.11 approved for payment.
A voice vote was taken with a unanimous affirmative result and the motion
was declared passed.
Alderperson Schultz made a motion for the Board of Aldermen of Clarkson Valley to adjourn, seconded by Alderperson Sittser. A voice vote was taken with a unanimous affirmative result and the motion was declared passed.
