Meeting of the Board of Aldermen of the City of Clarkson Valley at City Hall (Clarkson Executive Center), April 4, 2017.

The meeting was called to order at 7:30 p.m. A roll call was taken with the following results:

Alderperson King made a motion to move Agenda item (a) under New Business – Discuss Police Contract to Remarks, Petitions and Complaints, seconded by Alderperson Meyer.  A voice vote was taken to approve the agenda change with a unanimous affirmative result and the motion was declared passed. 

Alderperson Schultz made a motion to accept the Minutes from the March 7th meeting.  Alderperson King seconded the motion.  A voice vote was taken to accept the Minutes with an affirmative result and the motion was declared passed.   

REMARKS, PETITIONS AND COMPLAINTS 

Mayor Scott Douglass explained to those present, the City received three bids for the Police Contract.  He reviewed the cost comparison sheet that was handed to everyone along with the agenda.  He asked the representatives of the three bidding police departments if the information referenced on the comparison sheet was accurate and all three said yes.  He then said we are here tonight to hear from everyone interested in speaking.  

Mr. Paul Dzatko said he lived in Forest Hills in Clarkson Valley 35 years and is very pleased with St. Louis County Police.   

Mr. Tom Dillon who lives in Kehrs Mill Trails Subdivision asked about the difference in bids regarding coverage.  The three entities expounded on how they plan to fill the shifts.  Mr. Dillon then asked about their willingness to write tickets and commented that he does not want Clarkson Valley to become known as ticket writers.  All three entities responded that tickets are not intended to be a revenue getter. 

Mr. William Meyer handed a letter to the Alderpersons and said he is also speaking for Jim Shubert who was not able to attend tonight.  He stated Mr. Shubert is a resident of Clarkson Valley as is he and Mr. Meyers owns a business in Ballwin.  He and Mr. Shubert are very familiar with Ballwin Police and highly recommend them.   

Mr. Neville Kapadia who lives in the Kehrs Mill Glen Subdivision asked if the City would consider organizing an electronics drive.   

The three police departments gave fine points of their proposals and took questions from the Board Members and the audience.  Mayor Douglass thanked everyone for attending and said the Board would make its decision May 2nd.   

REPORTS 

St. Louis County Police Report:  Officer Wehner reported on the March 2017 Activity in the City.   

Mayor’s Report 

Court Report:  The total amount collected for traffic fines and court costs for the month of March 2017 was $11,417.50.  

Revenue and Expense Report:  Mayor Douglass asked everyone to look at the Revenue and Expense report and reviewed sales and utility taxes.   

Alderpersons’ Reports 

Non-Scientific Survey:  Alderperson Meyer, who was up for reelection today said he conducted a non-scientific survey while working the polling station.  He said of those he polled, the responses were: 4 positive for St. Louis County; 4 positive for Ballwin; and one positive and one negative for Chesterfield.   

Vines:  Alderperson Schultz reported that he drove through his subdivision with the company that maintains the common ground, Dowco.  They received a report that vines were growing on trees; however, when they looked at the situation they found that it wasn’t trees but rather utility poles.   

City Attorney’s Report

There was no unfinished business.   

NEW BUSINESS 

BILL NO. 0465 – AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF CLARKSON VALLEY, MISSOURI, BY ENACTING A NEW SECTION 210.275; PROHIBITING CONSTRUCTIVE INVASION OF PRIVACY IN THE CITY; AMENDING THE MUNICIPAL CODE OF THE CITY OF CLARKSON VALLEY, MISSOURI, BY ENACTING A NEW CHAPTER 236; AND PROVIDING FOR THE REGULATION OF UNMANNED AIRCRAFT SYSTEMS (UAS). 

Alderperson Schultz made a motion to discuss and pass Bill No. 0465.  Alderperson Meyer seconded the motion.  Mayor Douglass read Bill No. 0465 for the first time.  Alderperson Schultz said when you look at what the Federal and State have done with their regulations on drones, this makes more sense.  City Attorney Butler said that adding detailed conditions makes it easier to issue tickets to offenders.  He then questioned the wording in one of the paragraphs and there was further discussion.  Alderperson King made a motion to change Paragraph I on Page 3 to delete redundant text, seconded by Alderperson Setnicka.  A roll call vote was taken, with the following results.  Ayes: King, Meyer, Midyett, Schiller, Schultz and Setnicka.  There were no nays.  Whereby, Mayor Douglass declared the motion as passed. 

The City Attorney was asked if the wording in Paragraph K was necessary and he said the verbiage could be removed from the sentence. Alderperson King then made a motion to change Paragraph K on Page 3 to delete the word “knowingly” along with unnecessary text, seconded by Alderperson Midyett.  A roll call vote was taken, with the following results.  Ayes: King, Meyer, Midyett, Schiller, Schultz and Setnicka.  There were no nays.  Whereby, Mayor Douglass declared the motion as passed.  

Mayor Douglass read Bill No. 0465 the second time.  A roll call vote was taken for passage of Bill No. 0465 as amended, with the following results.  Ayes: King, Meyer, Midyett, Schiller, Schultz and Setnicka.  There were no nays.  Whereby, Mayor Douglass declared Bill No. 0465 as amended passed and is now Ordinance No. 17-01.  He reported that we would look at the penalty at a later date and then he thanked Alderpersons Setnicka and Schultz for the work they did on this Bill. 

Audit:  Alderperson Schiller made a motion to approve payment of invoices in the amount of $72,776.64, seconded by Alderperson Schultz.  A voice vote was taken to approve the audit with a unanimous affirmative result and the motion was declared passed. 

Alderperson King made a motion to adjourn, seconded by Alderperson Midyett.  A voice vote was taken with a unanimous affirmative result and the motion was declared passed.  The Meeting of the Board of Aldermen adjourned at 8:50 p.m.
