The meeting was called to order at 7:30 p.m. A roll call was taken with the following results:

Alderperson Schultz made a motion to accept the Minutes from the May 2nd meeting.  Alderperson Setnicka seconded the motion.  A voice vote was taken to accept the Minutes with an affirmative result and the motion was declared passed.   

REMARKS, PETITIONS AND COMPLAINTS 

There were no remarks, petitions or complaints. 

REPORTS 

St. Louis County Police Report:  Officer Wehner reported on the May 2017 Activity in the City.   

Mayor Douglass thanked Officer Wehner for his years of service with the City.  Everyone said they will miss his presence in Clarkson Valley. 

Mayor’s Report 

Court Report:  The total amount collected for traffic fines and court costs for the month of May 2017 was $10,435.00. 

Rumor:  He reported reading an article this afternoon generated by a local news station stating the City just signed on for police services with Chesterfield.  The author of the article posed the question, “could this mean annexation” and conducted an interview with Mayor Nation of Chesterfield.  They followed up with a call to Mayor Douglass and in addition to telling them “no”, he mentioned that we were not included in the St. Louis County 5-year plan that would have been necessary to file with the Boundary Commission.   

Additional Court Changes:  Mayor Douglass said there is a new 220-page document containing court procedures handed out this week.  So far, we’ve received 4 pages.  It appears the court is requiring a separate door for court from the city to ensure defendants know that court is separate from the city.  He said the cost for the extra door would run between $3,000 and $4,000.  We would also be required to install a partition between the two desks and counter.  This is the reason the police service agreement remained mute on the number of officers Chesterfield would supply on court night as this might all change.  He concluded by saying it remains to be a saga but we are on top of it. 

Sanitation Contract:  He reported we would discuss the sanitation contract tonight and said he spoke with Waste Management last week.  They will charge $0.20 per household additional this next contract year. 

Alderpersons’ Reports 

Golf Carts:  Alderperson Schultz wanted to remind everyone there are quite a few golf carts on the streets and to keep that in mind as you’re traveling on the roads in Forest Hills subdivision.  He said he has not witnessed any ordinance violations with underage drivers; children hanging off the sides; driving with too many in the cart; or misbehaving in general.   

Mass Mailing:  Alderperson Schultz said he would like to send a mass mailing explaining the ordinance about trash cans being visible from the street along with mention of the new police contract.  Alderperson Meyer added to the comment about trash cans being visible from the street, saying if we are not going to enforce the ordinance, we should remove it.  He said there are a few receptacles always visible at these same few houses on Kehrs Mill Road. 

Golf Carts – Revisited:  Alderperson Setnicka said Forest Hills is a charming neighborhood.  Some 16-year olds are responsible enough to drive golf carts without a drivers’ license.  She stated her 16-year-old doesn’t drive but would like to drive the cart.  She is very frustrated with this rule.  Mayor Douglass said we have an ordinance stating you have to have a drivers’ license in order to drive a golf cart.  He asked the Board if we want to maintain the ordinance or change it leaving it up to the parents’ discretion.  Alderperson King asked the City Attorney if allowing an underage driver puts the City in jeopardy for liability to which Patrick Butler said it does not.  He said we do not have a duty to protect people from themselves.  Alderperson Schultz said their indentures are silent on golf carts.  Alderperson Setnicka then made a motion to allow underage drivers on golf carts which died for lack of a second motion. 

City Attorney’s Report 

There was no report. 

UNFINISHED BUSINESS 

Police Service Agreement:  The Alderpersons brought up areas of importance to them regarding the initial proposal saying there was no mention of an assigned NPO; no mention of drug take-back, use of the sub-station or the number of assigned officers in court; and the termination clause leaves cause for concern.  Patrick Butler said Chesterfield is contractually obligated to provide “like kind” services to Clarkson Valley and when the statement about 18-days left and there is no signed contract, Mr. Butler stated they do not get a check until we get the contract. 

NEW BUSINESS 

BILL NO. 0467 – AN ORDINANCE AUTHORIZING A CONTRACT FOR COLLECTION OF RESIDENTIAL SOLID WASTE, RECYCLABLES, COMPOSTABLES AND AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE SAME ON BEHALF OF THE CITY OF CLARKSON VALLEY, ST. LOUIS COUNTY, MISSOURI. 

Alderperson King made a motion that we contract with Waste Management as our sanitation provider.  The motion was seconded by Alderperson Schultz.  Mayor Douglass read Bill No. 0467 the first time and explained there is a $0.20 per household increase from last year’s price.  Mayor Douglass read Bill No. 0467 the second time.  A roll call vote was taken with the following results.  Ayes: King, Meyer, Midyett, Schiller, Schultz, and Setnicka.  There were no Nays.  Whereby, Mayor Douglass declared Bill No. 0467 as having passed and is now Ordinance No. 17-03. 

2017-2018 Budget:  Alderperson Schiller made a motion to pass the 2017-2018 Budget seconded by Alderperson King.  A voice vote was taken with a unanimous affirmative result and the motion was declared passed.   

Request for Pyrotechnic Display:  Alderperson Schultz made a motion to allow Forest Hills Club Estates to hold its annual fireworks display this 4th of July.  Alderperson Midyett seconded the motion.  A voice vote was taken with a unanimous affirmative result and the motion was declared passed.   

Audit:  Alderperson King made a motion to approve payment of invoices in the amount of $88,944.56, seconded by Alderperson Setnicka.  A voice vote was taken to approve the audit with a unanimous affirmative result and the motion was declared passed. 

Alderperson Setnicka made a motion for the Board of Aldermen of Clarkson Valley to hold a closed meeting immediately after the adjournment of the regular open meeting to discuss matters falling under the provisions of RSMO Section 610.021(2), seconded by Alderperson King.  A voice vote was taken with a unanimous affirmative result and the motion was declared passed.  The meeting adjourned at 8:50 p.m.
