UNFINISHED BUSINESS

BILL NO. 0512 – AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF CLARKSON VALLEY IN TITLE IV, CHAPTER 405.040 BY AMENDING THE DEFINITION OF SWIMMING POOLS; AND AMENDING DEFINITIONS IN THE 2009 INTERNATIONAL RESIDENTIAL BUILDING CODE AND THE 2009 INTERNATIONAL PROPERTY MAINTENANCE CODE.

Discussion opened and a motion was made by Alderperson Bogosian and seconded by Alderperson Schiller to amend Section 2 of Bill No. 0512 to include an additional penalty clause giving the court an opportunity to impose a greater fine if they so choose to use it.  A roll call vote was taken to include the wording “and/or 500.085” in Paragraph B of the definition of Swimming Pools with the following results.  Ayes:  Bogosian, McNamara, Meyer, Midyett, and Schiller.  There were no Nays.  Whereby, Mayor Douglass the additional penalty clause will be inserted and will now become a part of Bill No. 0512.

A motion was made by Alderperson Meyer to discuss and pass Bill No. 0512 as amended, seconded by Alderperson McNamara.  Mayor Douglass read Bill No. 0512 for the first time and there were no questions.  Mayor Douglass read Bill No. 0512 the second time.  A roll call vote was taken, with the following results.  Ayes:  Bogosian, McNamara, Meyer, Midyett, and Schiller.  There were no Nays.  Whereby, Mayor Douglass declared Bill No. 0512 as having passed and is now Ordinance No. 22-04.

NEW BUSINESS

BILL NO. 0513 – AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF CLARKSON VALLEY IN TITLE II, ARTICLE VI OFFENCES CONCERNING PROPERTY, BY ADDING DEFINITIONS TO SECTION 210.280 TAMPERING AND BY ADDING A NEW SECTION 210.285 VEHICLE PROWLING.

A motion was made by Alderperson McNamara to discuss and pass Bill No. 0513.  Alderperson Meyer seconded the motion.  Mayor Douglass read Bill No. 0513 for the first time explaining the Tampering portion of this Bill is already contained within the code but we added a definition of ‘Vehicle’ along with a penalty.  Alderperson Bogosian asked several questions of Lt. Connelly, i.e. how much of an issue is this in the City, to which the lieutenant responded very low.  Alderperson McNamara stated her interest in this was not only relating to driveway break-ins but also with a greater concern with the commercial lots we have in the City.  The last question from Alderperson Bogosian was is this ordinance actionable if the police officer personally did not witness the tampering, to which Lt. Connelly stated personally witnessing by a police officer is the best way to prosecute but certainly with video, etc. it is prosecutable and this ordinance is narrow-focused and very specific.  Alderperson Bogosian ended discussion by suggesting we double or triple our efforts to remind our residents to be more careful.  Everyone agreed.  Mayor Douglass read Bill No. 0513 the second time.  A roll call vote was taken, with the following results.  Ayes:  Bogosian, McNamara, Meyer, Midyett, and Schiller.  There were no Nays.  Whereby, Mayor Douglass declared Bill No. 0513 as having passed and is now Ordinance No. 22-05.

Adding a New Planning and Zoning Commission Member:  Mayor Douglass stated everyone should have received the biography submitted by candidate Andrew Low and said Mr. Low has indicated Clarkson Valley is his forever home, further stating that having worked in government as long as he has, he is interested in working at a different level.  Alderperson McNamara made a motion to approve the appointment of Andrew Low to the P&Z Commission, seconded by Alderperson Bogosian.  A voice vote was taken with a unanimous affirmative result and Mayor Douglass declared Andrew Low as the newest P&Z Member and thanked Alderperson McNamara for bringing this recommendation to us.

Appointing a New Board of Adjustment Member:  Mayor Douglass stated everyone should have received the biography submitted by candidate Talie Manning and said Mrs. Manning is present at tonight’s meeting.  He mentioned she’s been President of Kehrs Mill Estates since 2019 and he said he has had an opportunity to work with her on numerous ordinance interpretations.  He concluded by saying she would make an excellent member of the Board of Adjustment.  Alderperson McNamara made a motion to approve the appointment of Talie Manning to the Board of Adjustment, seconded by Alderperson Bogosian.  A voice vote was taken with a unanimous affirmative result and Mayor Douglass declared Talie Manning as the newest Board of Adjustment Member. Everyone congratulated Mrs. Manning.

Resolution 22-01:  Mayor Douglass read Resolution 22-01 for the first time.  Alderperson Bogosian said there are currently no commercial buildings in Clarkson Valley with solar panels; nor are there currently any permit requests; nor are we aware of any permit requests being proposed.  He said he believes this moratorium is addressing a problem that does not exist.  Alderperson Schiller said when she proposed this moratorium last fall she was hoping we would quickly pass an ordinance requiring commercial building solar system applications to follow the rules stated in the International Building Code.  Everyone agreed we do not want to appear as though we are anti solar because that is not why we are doing this.  Mr. Bogosian asked if this would make us vulnerable to a law suit.  The City Attorney said a city can pass a moratorium on a temporary basis for further review or until proper legislation can be passed.  He reminded everyone the sole purpose of this Moratorium is to enable us to properly research and adopt a code the building commissioner can use if we were to receive an application in the very near future.  Right now, he said, there are no standards for weight, wind resistance, etc. for the building commissioner to use when considering an application for a commercial building.  Further discussion ensued and it was decided we would immediately begin work on the ordinance.

Alderperson Schiller made a motion that Resolution 22-01 for a Moratorium on accepting applications for solar energy systems on commercial-type buildings be amended to include a statement that this Moratorium will not be in effect any longer than four (4) months, seconded by Alderperson Midyett.  The City Clerk was asked to read the amended wording.

AMENDED RESOLUTION 22-01 – A RESOLUTION IMPLEMENTING A MORATORIUM ON ACCEPTING APPLICATIONS FOR BUILDING PERMITS ON SOLAR ENERGY SYSTEMS ON COMMERCIAL BUILDINGS (OTHER THAN RESIDENTIAL OCCUPANCIES) IN THE CITY OF CLARKSON VALLEY, MISSOURI UNTIL A NEW ORDINANCE IS PASSED AMENDING THE 2009 INTERNATIONAL BUILDING CODE NOT TO EXCEED A PERIOD OF FOUR (4) MONTHS.

A motion was made by Alderperson Schiller to pass Resolution 22-01.  Alderperson Midyett seconded the motion. Mayor Douglass read Resolution 22-01, as amended, the second time.  A roll call vote was taken, with the following results.  Ayes:  Bogosian, McNamara, Meyer, Midyett, and Schiller.  There were no Nays.  Whereby, Mayor Douglass declared Resolution 22-01 as having passed.
