The Chairman, Gregg Bogosian is attending tonight’s virtual meeting and Alderperson Schiller, who is present tonight, served as a Commission Member at the P&Z Hearing. There was an affirmative recommendation to this Board for Forest Hills Country Club’s request to locate a solid fence on the north side of the pickleball courts.
During the course of this Public hearing, comments, questions and concerns from neighboring property owners were heard. Mayor Douglass said if the fence is approved tonight, the City would expect a construction schedule to be received before the permit is issued.
The Public Hearing closed at 7:30 p.m.
NEW BUSINESS
BILL NO. 0494 – AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF CLARKSON VALLEY, MISSOURI, IN TITLE IV: ZONING REGULATIONS, ARTICLE IV. SPECIAL USE REGULATIONS; PARAGRAPH B, BY ADDING A NEW SUB-PARAGRAPH 17.
A motion was made by Alderperson Schiller to discuss and pass Bill No. 0494. Alderperson Midyett seconded the motion. The City Clerk read Bill No. 0494 for the first time. Mayor Douglass read the Bill in its entirety to ensure that the residents attending were familiar with the provisions of the Bill. Mayor Douglass read Bill No. 0480 the second time. A call for the vote was heard but the reluctance to cast the vote by some Board Members was palpable. Paraphrasing two questions/observations posed by Alderperson Meyer: It is his understanding the Club can construct the pickleball courts without the fence hence, no need for a Special Use Permit, to which Mayor Douglass responded that is correct. Second question; is this fence not the best effort to mitigate sound from the courts? There was further discussion from the Alderpersons at which point they stated they were ready to vote. A roll call vote was taken with the following results. Ayes: Blanner, McNamara, Meyer, Midyett and Schiller. There were no Nays. There was difficulty with Alderperson Schultz’s audio on this virtual call, however with five affirmative votes, Mayor Douglass declared Bill No. 0494 as having passed and is now Ordinance No. 20-07.
BILL NO. 0495 – AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO FOREST HILLS COUNTRY CLUB AUTHORIZING THE LOCATION OF A SOLID SIMTEK PRODUCT FENCE AT THE PICKLEBALL COURTS ON PROPERTY KNOWN AS 36 FOREST CLUB DRIVE IN THE CITY OF CLARKSON VALLEY, MISSOURI.
A motion was made by Alderperson Schiller to discuss and pass Bill No. 0495. Alderperson Midyett seconded the motion. Mayor Douglass read Bill No. 0495 for the first time. Alderperson Schiller asked for verification that we were voting on a 4’ tall fence and Mr. Donovan confirmed that. He said he would submit a final site plan; construction schedule; and a parking analysis to the City. Mayor Douglass read Bill No. 0495 the second time. A roll call vote was taken, with the following results. Ayes: Blanner, McNamara, Meyer, Midyett and Schiller. There was still difficulty with Alderperson Schultz’s audio on this virtual call, however with five affirmative votes, Mayor Douglass declared Bill No. 0495 as having passed and is now Ordinance No. 20-08.
Audit: Alderperson Meyer made a motion to approve payment of invoices in the amount of $69,054.30, seconded by Alderperson Schiller. A voice vote was taken to approve the audit with a unanimous affirmative result and the motion was declared passed. At this point, Alderperson Schultz resumed audio ability and said he, too, voted yes on the two Bills and the Audit.
CARES Act: Mayor Douglass stated we completed the first round of the application process for CARES funds and we will now enter into the Substantiation phase.
