June 9, 2023 Special Board of Aldermen Meeting

RECORD OF PROCEEDING

A special meeting of the Board of Aldermen was held on Friday, June 9, 2023 at 5:00 PM in the City Hall office at the Clarkson Executive Center in Ballwin, Missouri. The meeting was also accessible virtually via a Zoom link.

A roll call for the meeting was taken with the following result:

ABSENT

AGENDA APPROVAL

A motion was made by Alderperson Schweig, seconded by Alderperson Bogosian to approve the Agenda. A voice vote was taken with a unanimous affirmative result and the motion to accept the Agenda as presented was declared passed.

OPEN MEETING

A motion was made by Alderperson MacDonald to discuss and approve Resolution 23-04, seconded by Alderperson Schiller declaring a Moratorium on the Three (3) Day or Seventy-Two Hours’ Notice Requirement for Regular and Special Meetings and Meeting Agendas as Contained in Sections 115.100 and 115.160 of the Municipal Code. There was no discussion. A voice vote was taken with all affirmative responses. Whereby, Mayor McNamara declared the motion as having passed.

ARPA Letter (as it stands) to Subdivision Trustees – Revisited: Mayor McNamara said after Tuesday’s meeting where the City Attorney declared a vote as having not passed, he realized that he called that vote out of extreme caution. He went home and researched this issue and concurred with the three attorneys she met while she was attending a training seminar, who said the motion should have passed with the vote it received. In this event, there were six Board Members present. With the vote at three ayes; two nays; and one abstention, the vote should have passed. Mr. Butler gave a further explanation saying an ARPA rule change that happened subsequently, and he was trying to be extremely conservative. What is on the table tonight is Draft 7 stating the ARPA money will be distributed with a pro rata share. Alderperson Schweig made a motion to approve Draft 7 of the ARPA letter, seconded by Alderperson Midyett. Alderperson Bogosian made a motion to amend the letter and to consider Draft 8, to which City Attorney Patrick Butler stated the full Board has not received a copy. Mayor McNamara clarified all this by stating Draft 8 removed the second sentence. Alderperson Bogosian stated the exact wording, which was different then what was just stated; however, the motion made by Alderperson Bogosian died for a lack of a second. The motion on the floor that was made by Alderperson Schweig, seconded by Alderperson Midyett stands and a roll call vote was taken with the following results. Ayes: MacDonald, Midyett and Schweig. Nays: Bogosian, and Schiller. Voting abstention: Low. Whereby, the City Attorney declared the vote a tie. Due to the tie, Mayor McNamara voted aye and declared the motion as having passed and said we would send the letter as it stands.

ADJOURN

A motion was made by Alderperson Bogosian to adjourn the Special Meeting, seconded by Alderperson Low. A voice vote was taken with a unanimous affirmative result and the motion was declared passed. The Special Meeting of the Board of Aldermen adjourned at 5:25 p.m.
